For divorce granted in Scotland

ACTIONS of DIVORCE COMMENCED IN SCOTLAND:

In order to register a divorce, marriage MUST be registered first.

 

  • BEFORE 31/12/2020:
    1. Extract Decree of Divorce – in original format;
    2. Certificate referred to in Article 39 of Council Regulation (EC) No. 2201/2003 of 27 November 2003 concerning judgments in matrimonial matters - signed and stamped by the Court – in original format;
    3. “Dichiarazione sostitutiva dell’atto di notorietà” (“Affidavit for recognition of a Divorce sentence”, click HERE) duly completed and signed;
    4. copy of interested party’s passport.

 

  • AFTER 31/12/2020:
    1. Extract Decree of Divorce;
    2. letter from the Court stating:
      1. full name/s and title/s of issuing Sheriff Clerk/Extractor who signed the ‘Extract Decree of Divorce’ and the certified copy of original writ;
      2. Confirmation relating to the day the decree became effective in accordance with Scottish Law;
    3. “Dichiarazione sostitutiva dell’atto di notorietà” (“Affidavit for recognition of a non EU Divorce sentence”, click HERE) duly completed and signed;
    4. copy of interested party’s passport.

 The documents indicated at No. 1. and 2. must be:

    1. in original format – originals shall NOT be returned;
    2. legalised by means of APOSTILLE by the UK Foreign & Commonwealth Office (click HERE)

Please note that the documents listed above must be obtained, either directly or through a legal agent, from the Court who pronounced the Decree of Divorce and must be originals, as photocopies are not acceptable.

Please also note that the documents will not be returned by this Office.
