For divorces granted in Northern Ireland

LIST of DOCUMENTS (BOTH FOR PETITIONER and / or RESPONDENT):

In order to register a divorce, marriage MUST be registered first.

 

  • BEFORE 31/12/2020:
    1. DECREE ABSOLUTE;
    2. AGREEMENT FOR CHILDREN (only if there are children under 18);
    3. ACKNOWLEDGEMENT OF SERVICE (only if the judgment was given in default of appearance of the respondent);
    4. “Dichiarazione sostitutiva dell’atto di notorietà” (“Affidavit for recognition of a Divorce sentence”, click HERE) filled in and signed by the petitioner;
    5. CERTIFICATE REFERRED TO IN ARTICLE 39 OF COUNCIL REGULATION (EC) NO 2201/2003 OF 27 NOVEMBER 2003 (1) CONCERNING JUDGMENTS IN MATRIMONIAL MATTERS (SIGNED AND STAMPED BY THE COURT).

The documents indicated at No. 1, 2 and 3 must be:

    1. in original format;
    2. certified by the District Judge with the wording “I certify that this is a true copy of the original document filed with this Court”, dated and signed (by Judge)


  • AFTER 31/12/2020:
    1. DECREE NISI DISSOLUTION;
    2. DECREE ABSOLUTE;
    3. AGREEMENT FOR CHILDREN (only if there are children under 18);
    4. ACKNOWLEDGEMENT OF SERVICE (only if the judgment was given in default of appearance of the respondent);
    5. “Dichiarazione sostitutiva dell’atto di notorietà” (“Affidavit for recognition of a non EU Divorce sentence”, click HERE) filled in and signed by the petitioner.

The documents indicated at No. 1, 2, 3 and 4 must be:

    1. in original format – originals shall NOT be returned;
    2. certified by the District Judge with the wording “I certify that this is a true copy of the original document filed with this Court”, dated and signed (by Judge)
    3. legalised by means of APOSTILLE by the UK Foreign & Commonwealth Office (click HERE)

 

All the required documentation must be sent by post to:

NOTICE: Please note that although under Northern Ireland Law these documents are considered authentic if the Court seal has been applied, it is necessary to have them also signed by the Judge of the Court where the decrees have been issued.

Please also note that the documents will not be returned by this Office.
