Declarations of acquisition of citizenship by by legal benefit: law amendments.

We inform that the Budget Law for the year 2026 provides for specific amendments to Article 4, paragraph 1-bis, letter b) of Law No. 91 of 5 February 1992 (New provisions on citizenship).

In particular, the amendments provide that the declarations made by parents — at least one of whom is a citizen by birth — of minors born abroad who do not automatically acquire Italian citizenship, as provided for by Article 4, paragraph 1-bis, letter b) of Law No. 91/1992, may be submitted within three years (instead of within one year) from the birth of the minor or from the later date on which filiation, including adoptive filiation, to an Italian citizen is established. At the same time, such declarations have been made free of charge.
These amendments do not effect retroactively; rather, they enter into force on 1st January 2026. For this reason, the waiver of fees will apply only to applications submitted from that date onward, and no refund is provided for applications already submitted.

The requirement to pay the fee of €250 provided for by Article 9-bis of Law No. 91/1992 remains in force for the declarations referred to in Article 1, paragraph 1-ter, of Decree-Law No. 36/2025, to be submitted by 31 May of the current year.
