How to register a Divorce granted in Scotland

IMPORTANT: in order to register a divorce, marriage MUST be registered first.

 

  • DIVORCE GRANTED BEFORE 31/12/2020:
  1. Extract Decree of Divorce – in original format legalized by means of APOSTILLE by the UK Foreign & Commonwealth Office (click HERE) + translation into Italian carried out by one of the professional translator in the Consulate list (see HERE), the translation must be accompanied by a cover letter signed by the traslator;
  2. Certificate referred to in Article 39 of Council Regulation (EC) No. 2201/2003 of 27 November 2003 concerning judgments in matrimonial matters – signed and stamped by the Court – in original format;
  3. “Dichiarazione sostitutiva dell’atto di notorietà” (“Affidavit for recognition of a Divorce sentence”, (see HERE) duly completed and signed;
  4. copy of interested party’s passport.

 

  • DIVORCE GRANTED AFTER 31/12/2020:
  1. Extract Decree of Divorce – in original format legalized by means of APOSTILLE by the UK Foreign & Commonwealth Office (click HERE) + translation into Italian carried out by one of the professional translator in the Consulate list (see HERE), the translation must be accompanied by a cover letter signed by the traslator;
  2. Copy of origina writ of Decree/Initial application (in the event of simplified procedure) certified by the Clerk Office of the relevant Sheriff Court – in original format legalized by means of APOSTILLE by the UK Foreign & Commonwealth Office (click HERE) + translation into Italian carried out by one of the professional translator in the Consulate list (see HERE), the translation must be accompanied by a cover letter signed by the traslator;
  3. Letter from the Court in original format legalized by means of APOSTILLE by the UK Foreign & Commonwealth Office (click HERE) + translation into Italian carried out by one of the professional translator in the Consulate list (see HERE), the translation must be accompanied by a cover letter signed by the traslator. The Letter from the Court must indicate:
    • confirmation relating to the fact that the application had been effectively served to the Respondent (in the event of “absence” of the Respondent and/or Divorce by simplified procedure);
    • Confirmation relating to the day the decree became effective in accordance with Scottish Law.
  4. “Dichiarazione sostitutiva dell’atto di notorietà” (“Affidavit for recognition of a non EU Divorce sentence”,(see HERE) duly completed and signed;
  5. copy of interested party’s passport.

Please be informed that in case of incorrect or incomplete documentation, your application will not be processed.

IMPORTANT: documentation without translation into Italian and without cover letter signed by the translator will be returned to sender.

Please be aware that, if the documentation is complete and correct and the application can be processed, in compliance with Italian norms, ORIGINAL certificates must be kept in our records and shall not be returned.
